Terms & Service Agreement

These Terms & Conditions establish the framework for using TreG Technologies' website and engaging our technology, digital, creative, IT, security and business solutions.

By accessing our website, requesting a service, approving a quotation, making a payment, or otherwise engaging TreG Technologies for services, you acknowledge that these Terms may apply to your relationship with TreG Technologies.

01 / Agreement

Agreement to These Terms

These Terms & Conditions ("Terms") govern access to the TreG Technologies website and the provision of services by TreG Technologies.

By accessing our website, submitting an inquiry, requesting a quotation, approving a proposal, making a payment, or engaging TreG Technologies for a service, you acknowledge that you have read and understood these Terms.

Where a separate written proposal, quotation, service agreement or project agreement is provided, that document may contain additional terms specific to the relevant service or project.

04 / Commercial Terms

Quotes, Scope & Project Changes

Quotes and proposals provided by TreG Technologies are based on the information available at the time they are prepared.

  • A quotation does not automatically create a binding project agreement until it is accepted and the required engagement conditions are satisfied.
  • The agreed project scope determines the work TreG Technologies is expected to deliver.
  • Requests outside the agreed scope may be treated as additional work and may require additional fees.
  • Changes to project requirements may affect the delivery timeline and total project cost.
  • Prices may change where the requirements, scope or third-party costs materially change before work is finalized.
Scope Protection

We encourage clients to provide complete and accurate project requirements before work begins. Clear scope helps protect both the client and TreG Technologies from unexpected costs and delays.

05 / Payment

Payments & Deposits

Unless otherwise agreed in writing, projects requiring development or significant work require an initial deposit before TreG Technologies begins work.

Standard Project Deposit

A 40% deposit is required to initiate applicable projects. The remaining balance becomes payable according to the agreed project milestones or before final delivery.

Payments may be made through payment methods communicated by TreG Technologies, including M-Pesa.

TreG Technologies may pause work, withhold final delivery or suspend applicable services where required payments are overdue.

06 / Refunds

Refund Policy

Project deposits are used to reserve resources, allocate development time and begin the agreed work.

Non-Refundable Deposit

Once project work has commenced, the initial deposit is non-refundable, except where TreG Technologies expressly agrees otherwise in writing or where applicable law requires a different outcome.

Any remaining balance or refund consideration will depend on the specific circumstances, work completed and terms of the relevant project agreement.

07 / Delivery

Project Timelines & Delays

TreG Technologies will make reasonable efforts to deliver projects within the timeframe communicated in the relevant proposal or agreement.

Delivery timelines may change where delays result from circumstances outside TreG Technologies' reasonable control.

Client-caused delays may also extend the delivery timeline. These may include failure to provide:

  • Required content, images, documents or other project materials.
  • Necessary account access or technical credentials.
  • Required approvals or feedback.
  • Accurate project information or decisions required to proceed.
08 / Client Responsibilities

Your Responsibilities

Clients are expected to cooperate reasonably with TreG Technologies throughout service delivery.

Accurate Information Provide accurate and complete information required for the service.
Timely Materials Provide requested materials, content and documents within reasonable timeframes.
Access Provide legitimate access to systems and accounts where required.
Approvals Review work and provide approvals or feedback when requested.
Account Ownership Maintain appropriate ownership and control of your own third-party accounts.
Lawful Use Use TreG services and technology in a lawful and responsible manner.
09 / Client Materials

Client Content & Materials

Clients remain responsible for the content, information, images, videos, logos, documents, software and other materials they provide to TreG Technologies.

By providing materials to TreG Technologies, you confirm that you have the necessary rights, permissions or authorization to use those materials for the intended project.

TreG Technologies is not responsible for claims arising from client-provided materials where the client did not have the necessary rights or permissions.

10 / Intellectual Property

Ownership & Intellectual Property

Unless otherwise agreed in writing, ownership of the final custom deliverable created specifically for a client transfers to the client after the applicable project has been fully paid.

However, TreG Technologies retains ownership of its pre-existing intellectual property and general development resources, including reusable code, frameworks, libraries, templates, components, tools, systems, methodologies and technical knowledge.

Final Payment Matters

Where ownership of a custom deliverable is intended to transfer to the client, the transfer takes effect after the agreed project balance has been paid in full.

11 / Portfolio

Portfolio & Promotional Use

Unless a confidentiality agreement or specific written restriction applies, TreG Technologies may display completed projects in its portfolio and promotional materials.

This may include displaying a client's business name, logo, website, screenshots or a general description of the work performed.

Clients who require confidentiality or restrictions on portfolio use should communicate this requirement before the project is completed.

12 / Infrastructure

Hosting & Domain Services

Where TreG Technologies provides hosting or domain-related services, those services may depend on third-party hosting companies, registrars and infrastructure providers.

  • Domain availability cannot be guaranteed until registration has been successfully completed.
  • Domain registrations are subject to the relevant registrar's rules and policies.
  • Hosting availability depends partly on the infrastructure provider and network conditions.
  • Clients are responsible for renewing domains and hosting services where renewal responsibility has been assigned to them.
  • Third-party infrastructure outages may affect service availability.
13 / Ongoing Services

Website Maintenance

Website maintenance, technical support, updates, monitoring and ongoing management are separate services unless explicitly included in the original project scope.

Where a maintenance package or support agreement exists, the scope, response expectations and applicable fees will be determined by the relevant agreement.

Work requested outside an agreed maintenance scope may be charged separately.

14 / External Platforms

Third-Party Services

TreG Technologies may integrate or rely on third-party platforms, software, hosting providers, registrars, communication tools or other external services.

These services operate independently and may change their features, pricing, policies, availability or technical requirements.

TreG Technologies is not responsible for failures, outages, policy changes, suspension, discontinuation or other events caused by independent third-party providers.

Third-Party Dependency

Where a project depends on an external platform, TreG Technologies will make reasonable efforts to maintain the integration, but cannot guarantee permanent compatibility with a third-party service.

15 / Security

Security & Technology Risks

TreG Technologies takes reasonable measures to protect systems, websites, networks, applications and information within the scope of our services.

However, no website, network, application, server or digital system can be guaranteed to be completely secure.

TreG Technologies cannot guarantee protection against every possible cyberattack, vulnerability, unauthorized access, malware, data loss or security incident.

Clients are responsible for maintaining appropriate credentials, access controls and security practices for systems under their control.

16 / Acceptable Use

Acceptable Use

TreG Technologies' services must not be used for unlawful, fraudulent, malicious or abusive activities.

  • Unauthorized access to computer systems, networks or accounts.
  • Distribution of malware, malicious code or harmful software.
  • Fraud, scams, impersonation or deceptive activity.
  • Copyright, trademark or intellectual-property infringement.
  • Spam or abusive communications.
  • Activities that intentionally damage or disrupt systems.
  • Any other activity prohibited by applicable law.

TreG Technologies may suspend or terminate services where there are reasonable grounds to believe that services are being used in violation of these requirements.

17 / Confidentiality

Confidential Information

TreG Technologies recognizes that clients may provide business, technical or project information that is not intended for public disclosure.

We will take reasonable steps to treat information received in confidence as confidential, subject to information that is already publicly available, independently developed, required to be disclosed by law, or necessary for legitimate service delivery.

Where a separate confidentiality or non-disclosure agreement has been signed, its terms will apply according to that agreement.

18 / Termination

Cancellation & Termination

A project or ongoing service may be cancelled or terminated in accordance with the applicable project agreement or circumstances of the engagement.

If a client terminates a project after work has commenced, the client remains responsible for applicable fees relating to work already completed, committed third-party costs and other amounts properly due under the engagement.

TreG Technologies may suspend or terminate services where payments remain overdue, where the client materially breaches these Terms, or where continued service would create a reasonable legal, security or operational risk.

19 / Liability

Limitation of Liability

TreG Technologies will make reasonable efforts to provide professional and reliable services. However, technology services inherently involve risks and dependencies outside our direct control.

To the extent permitted by applicable law, TreG Technologies will not be responsible for indirect, incidental, special or consequential losses, including loss of profits, business, revenue, opportunities or data arising from the use of or inability to use a service.

TreG Technologies is also not responsible for losses caused by third-party providers, client actions, unauthorized access resulting from compromised client credentials, circumstances outside our reasonable control or misuse of delivered systems.

Reasonable Protection

Nothing in these Terms is intended to exclude or limit liability where such exclusion or limitation is not permitted by applicable law.

20 / Updates

Changes to These Terms

TreG Technologies may update these Terms from time to time to reflect changes in our services, technology, business operations or other relevant circumstances.

Updated Terms will be published on this page with a revised effective date where appropriate.

For existing projects, the terms contained in a signed or otherwise agreed project-specific contract may continue to apply according to that agreement.
